Cancellation right
You have the right to cancel this Contract within fourteen days without providing any grounds. The cancellation period is fourteen days from the date on which you or a third party specified by you, but who is not the carrier, have accepted the goods. In order to exercise your cancellation right, you must inform us ([netHEAVEN GmbH, Bonn Office, Thomas-Mann-Str. 19, 53111 Bonn, Tel.: +49 (0) 6131 / 97 27 501, Fax: +49 (0) 6131 / 97 27 506, widerruf@crespinegel.de) by means of a clear declaration (e.g. by a letter mailed, faxed or sent by e-mail) ̈about your decision to cancel this Contract. You can use to this purpose the attached cancellation form, which, however, is not mandatory.
For the observation of the cancellation period it is sufficient to send the notification about using your right to cancel before the cancellation deadline.
Sequences of the cancellation
When you cancel this Contract, we have to pay back to you immediately and at the latest fourteen days from the day, on which the notification about your cancellation of this Contract was received by us, all payments we have received from you, including the delivery costs (except for the additional costs which result from the circumstance that you have selected another type of delivery instead of the more affordable standard delivery offered by us). For this repayment, we use the same payment instrument which you have established at the original transaction, unless if something else has been explicitly agreed upon with you; in no case will there be any fees charged to you with respect to this repayment. We can refuse the repayment until we receive back the commodities or until you have provided a proof that you have shipped back the commodities, depending on which the earlier point in time is.
You must send back or hand over immediately the commodities to us and in any case within fourteen days from the day on which you have notified us about the cancellation of this Contract. The deadline is considered to have been observed when you have sent us the commodities prior to the expiration of the period of fourteen days. The direct costs for the return of the commodities are borne by you.
You are liable for any diminished value of the commodities only when this diminished value is resulting from handling other than what is necessary to ascertain the quality, nature and functioning of the commodities.
